The reason given for shooting the old man was that they yelled at him to put his hands up and he didn't hear them (hello Mcfly but he is a seasoned citizen and likely didn't hear you) and spun around towards the officers who then shot him. The old guy was reaching for a cigarette. It doesn't matter if the cops were looking for a burglar. They still have the have the responsibility to make sure the man is armed before they pull the trigger and shoot. Telling the judge "we thought he may have been armed" is no defense and you or I would be in jail.
