I'm not sure how the bank was "complicit" in the scam. OP says she consulted with her husband, so is he complicit too? It's her money. At some point people have to be responsible for their own conduct.
If she had gone to Cherokee and lost it all at the casino, or donated it to Joel Osteen or Benny Hinn, she would have the same chance of getting her money back.
I'm not a fan of the big banks, that's why I use a community bank. And the scammers should be hunted down like wild dogs.

I only blame the bank for not asking more questions. My step father is partly to blame. I think he is going senile. My mother is not far behind him. I had hoped that they would be ok long enough for my niece to mature and be able to take care of them. It does not look like it right now.
