Guy pulls gun on news crew!

Well, I agree that the kid is an idiot. That said, other than illegal parking, he didn't seem to break any laws.



I've never heard of a gun pointing at the ground which created a substantial danger of death/injury to another person personally. The sheriff is free to arrest him, but any half-wit attorney could beat that charge I'd bet.

That's the Mississippi statute.

Georgia's is:
(a) A person commits the offense of aggravated assault when he or she assaults:

(1) With intent to murder, to rape, or to rob;

(2) With a deadly weapon or with any object, device, or instrument which, when used offensively against a person, is likely to or actually does result in serious bodily injury; or

(3) A person or persons without legal justification by discharging a firearm from within a motor vehicle toward a person or persons.

and for the incident above, even the other somewhat relevant statute doesn't apply:
§ 16-11-102. Pointing or aiming gun or pistol at another


A person is guilty of a misdemeanor when he intentionally and without legal justification points or aims a gun or pistol at another, whether the gun or pistol is loaded or unloaded.

being that this occured in Joiner,AK , why exactly are we discussing what the MI and GA laws are on this and how they apply to what that dumbass did?

if anyone cares to post the law code and how they apply to what happened, how about someone posting the ARKANSAS law!?

§ 5-13-204 - Aggravated assault.

5-13-204. Aggravated assault.

(a) A person commits aggravated assault if, under circumstances manifesting extreme indifference to the value of human life, he or she purposely:

(1) Engages in conduct that creates a substantial danger of death or serious physical injury to another person;

(2) Displays a firearm in such a manner that creates a substantial danger of death or serious physical injury to another person; or

(3) Impedes or prevents the respiration of another person or the circulation of another person's blood by applying pressure on the throat or neck or by blocking the nose or mouth of the other person.

and I'm discussing GA law since a lot of people seem to think he violated the law, and since they live in Georgia I think they should realize that holding a gun in your hand (not pointed at anyone) is not a crime. A cop could try to get you for soem b.s. disturbing the peace charge or something, but if you don't point it at anyone you aren't breaking the law.
