Guy pulls gun on news crew!

ok. but, you have to see that his demeanor while holding a gun created a "substantial danger of death or serious physical injury to another person" no matter which way he pointed it. with that idiot, one more slight remark from the news crew and he most likely would have fired.
 
No, I can be pissed off, hold a gun, and not present any risk of injury to anyone else. For all I know, that was a toy gun. For all I know the gun was unloaded. For all I know, that gun had no internals. I know a guy was pissed, reporters did their usual bothering people crap, guy got more pissed off and grabbed a gun, never pointing it in their direction or making any verbal threat to actually use it. There was an implied threat when me and my brother decided to clean a couple guns when my sister was getting picked up for her first date and the guy was waiting for her, that doesn't make it assault.

The kid in the video was a hothead, a troublemaker, and acted inappropriately. That, in and of itself, isn't aggravated assault. Further action on his part "could have" made it so, but no further action did from what I saw.

Totally agree. Form the legal standpoint there is no assault. Other than that the guy is stupid to act like this in front of the camera.
