My 18 year old asked my to buy him a handgun

At least your screen name is honest.
Like I said, do whatever you like. A person that cannot legally obtain a firearm is not legal to receive one as a gift or otherwise. Asking someone to *wink* gift you a gun is a straw sale, plain and simple. If you are going to call someone a liar that knows the law inside and out, you'd better be prepared to get ball slapped.

I called a spade a spade. For all this law you claim to know you are still unable to provide the law that supports your claim. Hell, I even linked you all of the laws regarding section 44. So what is the hold up?

If his son is not a prohibited person (and at 18, he is old enough to own a firearm), then having a family member buy a firearm for him is not illegal so long as the buyer is honest and accurate on the 4473. His asking or not asking is irrelevant. A straw purchase only takes place when a buyer knowingly purchases a firearm for a prohibited person or the buyer makes false statements on the form 4473. What is so difficult for you to understand about that? I await yours or a member of your peanut gallery (that's you ACR man), to provide a statue or case law that proves otherwise.

Buy him one but keep it at your house and only let him have access to it with you. My 6 y/o has here own handgun, but she doesn't have access to it unless we are at the range.

What do you mean 'obtain'?
It's illegal for me to gift my son (he's 10) a firearm? If so, my dad was one heck of a lawbreaker.

I am sure your father is in the clear, nevermind the ****house lawyers they are always claiming something is illegal but when asked to provide proof, they always crap out.

So let me get this right. You are claiming that an individual that is not legally allowed to possess a firearm can approach you to fill out the paperwork on their behalf? Sure, have fun with that. I don't need to cite a law or statute, that is common knowledge.

A ten year old is not an adult.

When did I say that a non-prohibited buyer can purchase for a prohibited buyer? I didn't. You have a reading comprehension problem. The statement you made earlier was that it is a felony for someone to buy a gun for someone else if the person ASKED for the firearm as a gift. That is wrong. So long as the 4473 is filled out properly and the gift receiver is NOT a prohibited person there is nothing illegal about it.

Wrong, plain and simple. That is THE DEFINITION of a straw sale, you are just calling it a gift. If I wanted to buy up a bunch of guns for some gang members (for a large profit) and then "gift" them the guns because that's what we decided to call it, is that cool with the atf? If you went into a store and were delayed a sale of a new rifle and you really wanted it for a trip you were taking tomorrow, could you ask me to get it for you as a "gift" legally? No, no you cannot. That is a felony. Like I said though, have at it, I'll make sure to keep paying my taxes to pay for your bread and water.
