But it's stinks of the same behavior from the brace rule. 100's of pages of a "rule" change to punish the law abiding citizens....easy targets, rather than utilizing their efforts toward real criminals. There's a reason that they are bible length reads and I don't personally trust that it's only theater. But what do I know? According to the miserable prick sparked1 sparked1 , my comprehension skills are not up to par. I'll make sure to notify my college back home to revoke my communications degree.
 
I am not a lawyer, but I did stay at a Holiday Inn once. Reading a good portion of the document, I do agree with Gingerbeard Man Gingerbeard Man that there are major implications to this “change” and what is potentially being done on this site and others like it. Certainly the flippers are at risk. Tough to argue that someone who buys the hot, new, hard to find gun, and then puts it for sale the day after isn’t looking to profit, but the language isn’t always about actual profit. Taken from the Q/A section:

"A person actually “selling at a profit” does not equate to “engaging in the business” because a showing of actual profit - whether or not expenses and/or inflation are considered - is not required to be “engaged in the business.” Rather, it is the predominant intent of obtaining pecuniary (or monetary) gain from sale or disposition of firearms that matters. Moreover, because the person’s predominant intent to profit is the relevant fact, it does not matter how or whether actual profit is calculated. There is also language there about re-selling within 30 days of purchase or within 1 year if new and in original box. WTF?

By definition, having a hobby means devoting time, attention, and labor to that hobby. Bottom line, I think they are opening things up to be able to go after folks that are passionate about this hobby. And it makes no sense. Liquidate 1000 guns is fine as long as you don’t buy replacements. How does that help anything. IRS wants their take of sales.

Its purpose is to stop FTF sales and close gun shows. Okuma should call it anything but a gun show,beater boys gonna have 5 months to sharpen their pencils and climb all over some folks at a "gun show." Lets see over the summer how it shakes out. GB they never come to meet and greets

It's nothing like the brace rule, the brace rule was a complete reversal of their previous position and tons of opinion letters. A complete 180.

Honestly, everything I've seen on this is what I already believed to be the case, basically a bunch of opinion letters and unwritten rules that are now written rules.

It's Not a good thing, it's definitely them sending a message they'r more interested in ****ing with us hobbyist then going after actual criminal and gang activity and I definitely have zero trust in the ATF or Biden administration, but ultimately it's a big nothing burger. Before this rule the ATF could accuse you of being a dealer at anytime and for any reason, after this rule it's the same thing.

And I wouldn't take sparky's words to heart, it's just his opinion, a little abrasive but we're all big boys here.
