SBR Conversion and Form 1 Question

Hey all,

I have a rifle I will be converting to an SBR once I complete the Form 1 for it. The gunsmith that has said that they can do the barrel swap for me told me I could bring it in once I get my tax stamp for it. I read something about needing to engrave the gun (?) for the SBR conversion, but was unsure of how this is done/who this should go to if it needs etched into the receiver?

As for the other question I had, since "I'm" doing the SBR conversion, at least on paper, do I fill out the Form 1, then the Form 4, pay the tax stamp, and wait? I already have my trust, fingerprints, and passport photo electronically, so I'm all set on those fronts.

This is correct. You will need the trust name and city, state engraved into the "firearm." So if it's an AR, it needs to be the lower receiver. Whatever part the ATF considers the "gun." There are a lot of local shops that will do this for you. It can be laser engraved or mechanically.

All you'll need is a Form 1. Pay the stamp, wait, take the stamp and approved Form 1 to gunsmith. Gunsmith make SBR and give to you.
 
Only form 1 needed. Engrave the lower if it is an AR. Whatever is considered the receiver should be engraved. You will engrave with trust name and city/state.

You will pay the tax stamp electronically when you do the form 1.
 
My understanding (I'm not a lawyer) but I have converted 2 pistols to SBR with a form 1 and I have a trust. If it starts out as a pistol and is converted to an SBR it must be engraved with the trust name. That's how they did mine. If you build it from scratch on a multi lower you can just register the serial number with the trust.

They did my engraving after the form 1 came back OK. if you put it together (or even have all the parts together it "could " represent "constructive intent" prior to the form 1 being approved you would be in violation of the law (as I understand it). Be careful and have a lawyer look it all over.

The term is "constructive possession" but the rest is correct. "Intent" is very difficult to prove, "possession" not so much.

Meaning I’m good to buy the barrel and adapter for the suppressor, file my paperwork, and then once it comes back approved, bring to gunsmith, engrave, and install short barrel?

Correct. "Constructive possesion" is really just a boogey-man kind of thing anyways. The only way you would encounter it would be for the ATF to be in your home executing a search. By all means, don't tempt fate, but I also wouldn't worry about it too much.
