Short barrel rifle-no tax stamp

Another youtube channel fired this and it keyholes by design. At 50 yards it grouped pretty good and 100 was decent in 5.56. It's a strange firearm, but, ATF has changed their minds anyway. Back to SBR status.
That was probably their older design that had straight grooves instead of rifling. This new design has traditional rifling like any other barrel.
 
ATF ordered Franklin to stop selling it. Franklin is offering full re funds. From what I understand Franklin arguement was based on a ar chambered in 45 long colt. / 410. Thus the rifle is capable of firing more than one projectile. Franklin then started producing it in 5.56 and selling it. ATF then ordered them to stop. Probably more litigation coming but will probably have to be heard by the Supreme Court if they choose to hear it
 
I knew that was going to happen as soon as I saw the add. If I thought it would fly I would have went and purchased one. They were skating on very thin ice from the very beginning trying to push that by.
 
I thought the reversal on Chevron was supposed to prevent government agencies from being able to write these arbitrary rules by trying to interpret the law themselves. It was the ATF that started all this 'SBR mess' by allowing pistol braces and now they cannot close Pandora's box. Interpretation of the law is for the courts not the ATF.

It means that current and future prosecutions that rely on rules that were established as a result of Chevron deference MAY BE challenged in a court of law.

None of those rules will be struck down until someone challenges them in court and the challenge wins.

In this particular situation, this doesn't apply. The relevant law here is the GCA which was passed - including the definition of 'rifle' in 1968.

That wasn't the same rifle. That one had straight cut rifling. This one doesn't. It's a moot point anyway with the ATF reversing course.
