Stealing or not?

If an LEO tells you, "By the letter of the law, you can't steal anything. But as long as you don't shoplift anything worth more than $100 dollars, I'm not going to arrest or cite you."

1. Is it still stealing?
2. Do you partake?

Well I mean he LSU has a point. It doesn't make since that Leo can't do anything under a certain amount.
No, to be clear, the LEO CAN in fact cite/arrest the person for stealing less than the $100. But he has chosen to NOT enforce the law as strictly for a reason I'll explain later.
My question is simply since you know it won't be enforced up to a certain limit, is it still stealing and is it still wrong to participate.
