Lots of places are already offering "free" tax stamps on some cans.
ATF is not going to allow shade tree machinists to start making and selling silencers. That's still being engaged in the firearms biz, and would require an FFL and SOT.
I’m sure it’s been said, but given the rush that’s inevitable once the tax falls off on Jan 1 I’d say if there’s something you want the best strategy is to talk with a local reputable shop. Ask them about going ahead and buying whatever and having them hold it for you until after the first. Some will, some won’t but it’s definitely worth an ask to try to beat the rush.
Hopefully the courts will rule that you're wrong on this.
Logic (not a term known by many politicians I know) dictates that the firearm is the second "F" in FFL, and a suppressor is just a muffler.
Hopefully the courts can muster up some of that logic. No breath will be held here, though.
Congress can define what a "firearm" is however it wants... and it already declared that a silencer (to use the term used by Hiram Maxim who invented and popularized the device 120 years ago)
*is* a type of firearm.
Just like Congress can and did declare that a "firearm" that is an antique is not really a firearm, even though it can kill you stone cold dead and millions of people WERE killed with such antiques between the time firearms were invented and the year 1898 when Congress drew the line for defining an antique.
No court is going to overturn that and say that judges have the power to define what a fireaRm is contrary to what Congress specified.
