Couple of thoughts on this.

If the buyer paid $100 for a Rolex with a battery, then it's the buyers fault.

Did the seller try to pass it off as original? If so, then the seller needs to make it right. How they do that is a negotiable. Everyone has an idea on what would make it right. As a buyer, I would come straight forward with what I expect to happen to make it right and work from there.

I've accidentally sold a KAC broomhandle that was a fake. When I bought it originally they were $10 during GWOT as surplus and I didn't know they faked them. When it was pointed out, I offered a refund. It worked out, but sometimes it happens.

I've had people try to sell me fake silver, on ODT. Didn't seem like they meant too but it happened.

Caveat emptor of course, but we all should be honorable in our life and dealings.

I'm still amazed by the low end **** that gets counterfeited. I have a set of fixed rifle sights I bought on eBay for under $20.00 a few years ago. When they arrived I saw "Daniel Defense" on one side of the rear sight. Now that wasn't in any of the pics when I looked at them. And I assume the chances of them being legit are some fraction of a percent. I wouldn't have bought them if I had seen that ahead of time and I ain't bought anymore or anything else from that eBay seller.
But I hear about knockoff Magpul stuff as well as other brands all the time. How cheap does a knockoff have to get to make it worth it? And how can it be worth it to the ones making/selling it?

Makes you wonder what the actual profit margin is on the legit branded stuff.
 
I think, according to "tha roolz" if you can demonstrate that the item was misrepresented, a neg should stick but could be challenged by the scumbag seller.

That depends on the reading comprehension skills of a mod (don't hold your breath) and I suppose THEY make the final determination of whether the item is counterfeit or not.
