Whose Fault Would It Be?

If I am pulling out onto 278 which is a 4 lane(2 on one side of grass 2 on other) and there is a semi truck coming in First lane with a good and safe distance and I pull out because it’s clear and then a car from the 2nd lane comes into the same lane I’m trying to merge into and almost causes a collision. Legally, Whose fault would that have been? I mean as far as the time I was pulling out, it was clear until he tried to cut over after I pulled out. I saw it just in time to swerve out of the way.

It is always the responsibility of the person entering/merging into traffic to yield the right of way to the thru traffic. It would have been your fault.

Nope, would have been the OP fault. He failed to yield to oncoming traffic.

Yes, the lane changer is rude but it is within the law to do so.

Even IF the OP made it into the lane, the OP still failed to yield and would have been at fault, even if the OP was rear ended.

Not unless he was able to enter the lane and establish (come up to speed of the other travelers). Simply turning into a lane does not give you right of way from any oncoming traffic.

I kinda figured the legal answer would be “my fault” even tho there was no blinker indication or anything else to tell me he was changing lanes. There is a turn lane leading to 92 that I had to go across to get into that lane and he may have thought I was getting in the turn lane and then moved over to where I was going. It was pretty close with some horn blowing by them that I’m pretty sure most could translate what it means but no collision.

I’ve heard that was a good brand but I’ve just never gotten a camera because it’s too complicated to set up and I want something easy enough that the videos go straight to my phone and I don’t have to download them on to a computer that I don’t have.
