It is coming from China and I don't think the Chinese government cares about patent infringement.
From what I read, it is illegal if it carries the trademark.
For example an "Acog style" sight is OK but a, "Acog" labeled item carrying the Trijicon label is a counterfeit.

From my understanding, the law (In the US) focuses on the importers and sellers, not buyers, since it is difficult to prove the buyer knew any better.
If you are a tourist outside the US and bring counterfeit items back to the US with you, about the worst you will see is CPB confiscate it, but, that is rare. If you buy a fake Acog, and knew no better, and if actually become involved in an investigation, you'll likely just lose the item to the counterfeit investigation of the seller......

Right now the Chinese industry seems to be very good at copying things.
When they start innovating, we are in a bunch MORE trouble...
