I have a problem I just can't seem to get my arms around. Situation is this -- My wife and I were in her car when a young lady ran a stop sign and hit us hard enough to turn us 180 degrees in the road. There was a witness who told the investigating officer that she ran the sign. The lady also admitted she went thru the sign. He cited her to court. Her insurance company, which is Progressive, fixed the damage that was obvious but refuses to put our car back to where it was originally. the rear hatch has a huge gap between it and the body, the rear door is out of alignment and the roof is bent. The underside shown damage to the exhaust and the frame. They claim previous damage. The car has never been in an accident before. I know I have to sue the lady but my problem is that I don't know what to ask for. I've been to two body shops but they say they can't tell how much to fix it till they get it taken apart. I think their problem is that I'm looking myself and they just don't want to invest any effort. I also need to be able to show the judge how much my car's value has dimished because of being in a wreck. Where can I find someone that could help me find my answers? I'm willing to compensate anyone for their trouble. Thanks for reading my sob story.

that panel gap is ridiculous! any shop should have seen that and told the insurance more work needed to be done. how new is the car? if its relatively new might be a good idea to just take it to the dealership

i deal with this fairly regularly

unfortunately no attorney is going to want to get involved in a property only dispute on a car (unless it is alot of money at play). they will but unless it comes down to a matter of principle you will likely spend more on attorney than you would at getting a recovery.

as for progressive, ya they are dicks. send them a letter (everything in writing, dont bother speaking to them on the phone as alot of the time they will just ignore whatever conversation you had or their supervisor will). simply state that the repair was half assed and not up to standard, that you intend on taking it to a professional to get it fixed, and will send them the bill (include pictures, MVA report, whatever you can). they will balk of course but you have to assert your position a few times. if they refuse to budge on the third attempt then id just take it to small claims and sue the driver and quit speaking to them unless its in court

Certified letter and make copies each you send

Should have never accepted the car as it was when you went to pick it up after the initial repair work was done. Good luck getting it sorted.
