Both taillights out hit from behind

just curious, if someone has both taillights out and driving at night whether on a highway or road, they get rear ended, is it still the persons fault who hit them from behind or could some arguement be made that the car in front had no taillights and therefore couldn't be seen?

There is absolutely no reason to rear end anyone, ask any traffic court judge or lawyer.

They'll ask how did you not see what was directly in front of you???..

Then they will remind you its your responsibility to be in control of your vehicle at all times.

back off and turn on your high beams so their reflectors work and give you some depth perception

Hard to prove tail lights were out after you rearend it and break both of them

It would be hard not to see the back of a car now with the reflectors built in the tail lights and the reflective tags.
