Both taillights out hit from behind

just curious, if someone has both taillights out and driving at night whether on a highway or road, they get rear ended, is it still the persons fault who hit them from behind or could some arguement be made that the car in front had no taillights and therefore couldn't be seen?
 
There is absolutely no reason to rear end anyone, ask any traffic court judge or lawyer.

They'll ask how did you not see what was directly in front of you???..

Then they will remind you its your responsibility to be in control of your vehicle at all times.
I would ask them but I tend to stay away from those people lol
 
It would be hard not to see the back of a car now with the reflectors built in the tail lights and the reflective tags.
