AO "gets away" with this by calling them special orders. But in most cases you can loose your merchant account if you get reported for charging a card and then not shipping a product.

We have been blasted on the web by "stealrain". This is interesting because only one person has asked for a refund, and nearly all the orders from the February orders have been filled. We are shipping out the last 8 uppers of this production run as fast as we can, also all but 15 people have received their completed lowers, and half of those are awaiting paperwork from the receiving FFL's. The comment has also been made that we oversold, that is not correct, we opened 500 slots to the general public, we also have our core business as a manufacturer. We have obligations to our stocking dealers as well as LE and Federal contracts to fill which is our primary business, when raw materials are available over our required production schedule, this is when we open orders to the general public.

Why don't you guys split the $40. Build this guy his rifle and give him a free magazine or pizza! Everyone happy. It's hard to believe all this is going on over $40. As a biz owner myself sometimes you need to loose a few bucks just to make someone happy. You just can't do it all the time.. This seems like an isolated incident. Make this man happy.

If there was no guaranteed date of delivery, and the upsell on the Palmetto lower is not required in order to receive the benefit of the original bargain, I just can't see how the OP was wronged. This is why I do not backorder or preorder anything-- I know that, at some point before delivery, I'll get sick of waiting.
