I have guardianship over a 5-year-old who was removed from his home by Department of Family and Children Services because his "parents" were declared incompetent due to addiction and neglect. I've had him for over a month now and have yet to receive any formal written instructions from DFCS or the Court. Because I'm dumb but not stupid, I messaged the case manager at DFCS that my wife and I would be taking him to our condo in Florida for a week in late March. The case manager messaged me back that she would have to get the permission of the mother before I could take him out of state.... WHAT? You mean the mother that was declared incompetent and the mother that you removed the child from, that mother? Yes, that mother.... I've seen (and done) a lot of stupid, nonsensical stuff in my life but to need the permission of someone whose child was removed because they're a derelict is stupid on steroids...

Am I wrong? What say you, collective oracles of ODT...
 
No, you aren't wrong. DFCS is ripe with incompetence and corruption. My mother works in foster care with Henry County Schools, and the stories that she tells daily about how terribly DFCS operates is really quite disturbing. It seems to be another one of those situations where the whole institution is so far down the drain that it can't be fixed in its current state.

What does Georgia law say your rights, responsibilities and restrictions to this guardianship are?
I’m just gonna go out here on a limb, since you asked? And say my opinion.

I would be Very careful .. you can certainly open yourself up to real issues crossing state lines with a minor, after being informed of required previous permission requirements.

My advice. Hire a babysitter for the weekend for the 5 yo and go to your condo in Florida.
Otherwise find somewhere in Georgia to vacation this summer instate.

My BILs GF worked there. He claims she’s borderline suicidal. She has major issues shes not dealt with in her daughter’s suicide. And this was years ago. I’d hate to see how she has handled things.
 
You asked permission/ guidance from government agency. Now they KNOW. You’ve had the child a month with no interjection from government or parents. I would have kept my mouth closed and went on vacation. Chances are they would never have know. But if they somehow found out well then that’s a bad day. Stay in Georgia until this gets worked out. Just an opinion.
