I was thinking about gifting one of my pistols to my parents for home protection and I hit a huge brick wall and don't know where to go.

I don't want to make this a debate on what is better for HD, my question resides in how to legally give it to them.

Parents live in Texas now, but also own, maintain and live in their house in GA at least a total of one month a year if not more. I don't know if they have TX or GA DL's and I guess that would be a pretty big clue as to what state the government sees them living in.

How would you guys handle this?

Easy fix as a gift, or stay clear and let them do it on their own accord in TX?

Thanks!

If they have GA drivers licenses (which sounds doubtful from the one month description) then it would be relatively easy ---if they are actually residents of TX I *believe* the only legal route would be sending it to a TX FFL.

Seems to me that if they maintain a residence here in GA there are GA citizens if here for longer than 30 days. Here's what the BATF says about purchasing guns in different states:
BATF said:
If a person maintains a home in 2 States and resides in both States for certain periods of the year, he or she may, during the period of time the person actually resides in a particular State, purchase a handgun in that State. However, simply owning property in another State does not qualify the person to purchase a handgun in that State.

Not sure that totally answers your question, though....

I would avoid the whole residency issue by transferring the gun via FFL (GA to TX). It's worth not subjecting yourself to potential problems.

If they do not have a GA license, how is the FFL holder going to be able to transfer to them? Transferring is virtually the same as selling.

Give them the gun and don't sweat it. If they have to use it, no one is going to ask for proof of ownership, then come put you in jail. In GA, there is no registration, no requirement to have a bill of sale to prove you are the actual owner.
