HOA Discrimination?

"Commercial Vehicles, of all types and kinds, are prohibited from being parked within the subdivision for a period of time exceeding twenty-four (24) hours except during the construction period of a residential dwelling, remodeling, or routine deliveries. This specifically includes but is not limited to all types of commercial vans, trucks, pick-up trucks and automobiles bearing commercial insignias larger than one foot square."

The way this reads, you can park it for 23 hours and 59 minutes, start it up and move it a foot, then leave it for another 23 hours and 59 minutes without being in violation. The moment it is moving, it's not parked any more.

Just a thought.

Based on your post it doesn't look like the rules specify what the construction or remodeling has to entail and it sounds like you're in construction so start a never ending remodel project.

If you have a privacy fence, start replacing the screws in the boards, one screw a day, apply stain or sealer with a kids paint brush, one inch a day, paint the inside of closet door jambs an inch a day, patch holes in the garage drywall, always leaving an extra hole right beside the one you just fixed, caulk around windows etc.

As long as their isn't a minimum amount of work specified they can't say anything until they amend the rules again.

Just make sure you can show some work in progress if the rules say they can inspect it. Even if you have to spring for a permit it may be worth it to shut that hoa nazi up.

I wish we had an enforced HOA (ours is voluntary, which means it does nothing, at all). The exact same homes in adjoining neighborhoods to my hood are 15-20% more in selling price simply because of the APPEARANCE of the neighborhood.
If you don't like rules that keep uniformity and should be designed to promote property values (THE biggest investment for most people) there are more neighborhoods withOUT covenants than with. Yet most people want to move into neighborhods WITH covenants and then female dog about them and try and skirt them.
Everyone likes to complain about liberals/Californians/Yankees/whatever... that move here and try and change it to the way it was where they lived and don't see the irony of moving into a covenant enforced neighborhood and trying to change, or worse, skirt, the rules.
OP - you are RENTING. You may or may not have any legal standing at all against the HOA. If you have a problem with their rule, move. I assume your work vehicle is a long term issue for you. It's not allowed. I assume there is not way to allow for parking behind the house. Move.
No one has addressed your question about selective enforcement regarding the ladder rack. There is no rule about the ladder rack based on what you posted so yes, the president doesn't want to look at your truck directly across from their house and is making up a rule. If it was ONLY the ladder rack, I'd ignore their request until they could provide documentation about your non compliance. But it's not, since you have the lettering.
You can be as professional and calm in trying to get it resolved or as difficult as you want to be with you new neighbors in a neighborhood you intend you to buy into. The 'wisdom' of both tactics is up to you.
I'm the first one to admit I want to live on acreage in a rural setting so the only rules about appearance of my place are set by me but I'd be the last one to move into a place with EXISTING rules and then belly ache about it or worse inflict my wants via non compliance onto others that signed up for and are playing by the rules.

Im an advocate of this HOA. It does what it's supposed to do obviously because we were drawn To the neighborhood.

Im not a fan of someone telling me I cant do something based on rules that aren't enforced up the street.

Im not against the rule I'm against selective enforcement.

Nobody wants to live in the Nazi Police State of a HOA that enforces ALL OF THE RULES... Some have management companies that go through and do an inspection of every property - every month. The ones that are run by people in the n-hood usually enforce the ones that people complain about.

I know, most of my post was addressing the posters who want to be creative about not following rules they agreed to follow, and don't understand (apparently) the value of covenants in a neighborhood that ironically they were drawn to. Rules are always for the other guy it seems. And yes, I get the nazi HOA's that get themselves concerned over some storage shed in the backyard no one can see not being on the approved pastel color palette. This ain't that.
You have a legite beef about selective enforcement of unwritten (made up) rules about the ladder rack. Not sure if as a renter you have any standing however to 'sue'.
But to me you still have a bigger long term issue. If you need a lettered work truck that can't be parked inside a garage or out of sight per the rules, what are you going to do?

If you go to work everyday it is not there for 24 hours, therefore you are breaking no rules. On the weekends just go run an errand for 10 minutes then come back that is less than 24 hours. The way it is written has holes.

Yeah when I re read your post it dawned on me you were addressing others as well. My apologies. Although they ARE fun to read.

Right now now the truck is at my I laws about 10 minutes away. The neighbor owns a farm about a mile up the road that he told me to park anything there at anytime. So I'll probablly move it there.

I think I was unintentionally misleading when I said I drive a company truck. I have a company truck that I drive back and forth and around during my 8 hours to work. I Drive my personal truck all other times.

It's a crappy situation. I know if I fight it they will just make the other guy move his truck, which I don't want to be that guy, yet I wasnt raised to sit idly by. Not much I can do as a lessor I'm sure. Probably just easier to move the truck closer to the neighbors farm and let it go.
