House to house searches

Hypothetical situation:

An unidentified man has kidnapped a 7 year old girl. He informs police, via a burn phone, that he is going to kill her in 3 hours. The only location information they have is the single cell-tower the call was originated from. There options are to do nothing or search every home within range of that tower to try and rescue the girl in time. Do you
a. Refuse entry to search, thus causing the already limited resources and time to be additionally depleted as they must now try and determine if you are in fact the man who is threatening to kill the girl, possible causing them to not find her in time?
or
b. Allow them to quickly run through your home so they can continue their search?

No gorilla tactics needed and a camera recording from your angle would not show what the officer saw, only what you saw.

Just because you would violate people's right doesn't make it right.
 
Rights can be suspended in this country. The Constitution even specifically mentions some of those cases. Additionally, the existence of rights does not mandate that those rights be exercised at all times. Sometimes it is better to be silent even though you have the right to speak, and sometimes it is better to allow a search even though you have the right to refuse it.

Rights can be suspended but a fugitive search is a stretch especially if this guy is mirandized like a common criminal.

A. Since I know I didn't kidnap the girl, and they don't have a right to search my home without a warrant or my consent, I can save them valuable time by not having to search a home where the girl is not.
 
I would let them in and talk about fishing. Then inform officer number 3 that his Eotech is on backwards while pointing out to officer number two that having two drop legs on one leg is counter productive. Then point out to officer number 5 that his front sight is bent on his AR. Then ask them why they are wearing DCUs in a city with green foliage. Then I would tell officer number six that his PMAG is in backwards. Then I would ask if they have had any luck with the catfish at the local lake lately.

You can decline a search without a warrant. You do have that right. That does not mean that you should always exercise that right though.

In this case, what will be interesting is.... if the cops searching the houses notice anything (like firearms) did they make notes about the location... for followup later? Hmmmm. They violated a lot of rights yesterday. Just sayin' :)

I would, under no circumstance, allow my home to be searched without cause.
 
Tell that to all the Katrina People that had their Guns taken away at Gun Point By National Guard Squads. Also a Declaration of Martial Law, Suspends all Constitional Rights. Maybe ya need to read up and look up some Factual occurances. I admit I don't Know it all. But there are things in the Patriot Act that go Against the NORMAL operation of things. Such as No Maranda and quite a few other things, some of these things were Covered on the News last night. You really need to be informed.
Also if Martial Law was Declared:

1. CONSTITUTIONAL RIGHTS ARE ENDED-Under martial law, the U.S. Constitution is suspended and the citizens immediately lose all the protections, safeguards, and human rights guaranteed by that document. The citizens also lose every rights and privileges granted under The Bill of Rights. The constitutions of other countries will likewise be suspended with similar conditions imposed upon the citizens of those other countries.

2. CURFEW ENFORCEMENT-Anyone caught outside after curfew can be shot dead. There are no exceptions for personal emergencies unless of course, these people have some sort of official written permission or are in possession of other material which gives them a “Get Out Of Jail Free” card.

3. WRIT OF HABEUS CORPUS SUSPENDED-This means that soldiers can bust into your house, or arrest you on the street without warrants, and can throw you into prison without explanation or access to legal counsel. They can hold you there for months, even years, since there are no time limits imposed on how long you can be imprisoned.

4. PERSONAL FIREARMS WILL BE SEIZED-Armed forces can invade your home and force you to surrender any weapons you have, regardless of your constitutional right or need to bear arms for your self-defense. If you refuse, you could be shot dead in your living room, and all your possessions seized. If you’re lucky, you might just get Tasered, or butt-ended with an AK-47, to eventually wake up in a Federal Emergency Management Agency (F.E.M.A.) Detention Center with a Prison Identification Number which you will go by as a “name” instead of your old name, the one on your birth certificate.

5. PERSONAL PROPERTY CAN BE SEIZED-This means that under the excuse of “requisitioning”, soldiers can kick you out of your home, and seize both your home, all the contents inside that home, as well as any vehicles, or other items you have on your grounds. They also can claim the actual real estate of the acreage as well. If you refuse or resist in some way well….I guess you can fill in the blanks or use your imagination.

So Yes Your Rights Can Be Suspended.

Good post. Some of those guys from Katrina were pretty damn big and bad (seriously), and they had their rifles confiscated. Nobody knows until it happens. HGUN did have a correct point about it being illegal. They shortly implemented HB 760 into law after the fact.
I have a wife and kid. I honestly don't know how I'd respond to 20 officers/FEMA/Blue Helmets/etc. from all corners of the house if it came to a SHTF situation.
