maybe i missed it?

It's whatever you make the upper. If you put on a 16" upper, its not NFA sbr anymore but if you put in a 16" or less, its a sbr and requires stamp.
 
Even though you put a 16" upper on it it is still registered as an SBR and would require a form 1 to transport across state lines I believe.

Incorrect as long as you do not have your short upper along for the ride.

Well I believe I was wrong then. The wording on that is weird though. The part saying "the firearm is still be subject to all requirements of the NFA"

Correct....I believe the operative phrase here is "If the registrant retains control over the parts required to assemble the SBR or SBS" then NFA rules apply. You do not have "control" over the parts (short upper) if they are not with you.
