The moment you've all been waiting for... (Obama to announce plan tomorrow 1/16/13)

I'm inclined to believe Obama's handlers are not going to allow him to repeat history by alienating the pro gun people to the point that they storm the election booths in 2014 and take over both the House and Senate as they did after the Clinton ban. They will most likely continue to beat their chests to appease their base but only go after the low hanging fruit for now such as expanding background checks, record sharing, and perhaps initiate the federal database that is being proposed. While the fight goes on for those restrictions, the Obama people will be fast at work behind the scenes setting the stage to win back the House and keep the Senate at the next mid-terms. If successful, they will then have the ability to appoint one or two Supreme Court Judges to their liking. That is the real danger we face, on many fronts.

Meanwhile, another school shooting dominates the news while justified home defense shootings are mostly ignored.
 
We should do a Wyoming is doing and create state wide legislation nullifying any federal laws on firearm restrictions.

X2. I think is the most likely action for now. Ask for everything, take a little, while waiting to get it all.
 
I can see Obama attempting to limit magazine size through an Executive Order, since the magazine is not considered a firearm. Many other things are not considered firearms according to the ATF (barrels, bolts, stocks, sights, etc).

What does this mean? Appoint someone to head the ATF that will go along with whatever restrictions to non-firearms Obama sees fit to impose via EO. This is one of Biden's 19 recommendations.

Some of the other suggestions and how they might be used to limit firearms ownership:

- Closing the "gun show loophole", which is to say, limiting all firearm sales to FFL dealers. FFL dealers are at the mercy of the ATF. See above.

- Add classes of people to the list of those unfit for firearms ownership. 18 U.S.C. 922(g) has some pretty broad classes of people already, such as anyone who "is under indictment for, or has been convicted in any court of, a crime punishable by imprisonment for a term exceeding one year". Note that this doesnt say specifically that felons are banned from gun ownership. What if all of the sudden it became possible to imprison someone for over 1 year for anything? Oh wait, it already kind of is...

- Restrict ammunition purchases. Again, ammo is not a firearm and is not controlled or guaranteed by the constitution.

- Require gun registration. This could be contested under the Firearm Owner's Protection Act, but keep in mind Class 3 items and anything else controlled under the National Firearms Act are already being limited and controlled and registered. This is infringement, as excluded by the second amendment. Since this legislation is already in place, all Obama would need to do is create a new database to use for registration and the FOPA would not apply. Disclaimer: IANAL, this is all from my reading of the laws.

- Limit the areas in which guns can be carried or used. Make public gun ranges require some type of permit for operation, and make that permit very hard to get. Make it illegal to carry a gun within X distance from a school (imagine the Gun Free School Zones Act on crack). Limit carrying a gun anywhere near any government building. Or even enact "gun zones" where it IS legal to carry, making it illegal to carry anywhere else.
