I found a store front FFL from another state that bought a like new firearm that the seller said had been fired and rated it at 98%(the add is archived),the store front FFL is now selling it as new in box,unfired. Is this illegal or just bad juju.

I would think it is false advertising.

Just means you can not trust them. Unless they let the new guy put a tag on it.

Even if it had not been fired, it would still be a used gun.

It is the same gun for sure. Advertised as "new in box". I would think an FFL store front would not be able to give a false description of a firearm for sale by them.

By all means, if you know for a fact that it is the exact same gun down to the serial number, out them. Just keep in mind that FFLs often have multiples of the same gun and if you are wrong it could end badly for you.
