The problem with the hand cut rule is that is has no scale. It is absolutism. Steal food to feed your baby, lose a hand. Rob a bank, lose your hand. Discretion is an important function of our system of law.

Also consider what serves society or what is justice. Does cutting a hand really stop a thief? or does it make for 1 handed criminals since they are forever marked, reintegration would be impossible.
