I am a legal firearm carrier. I have been serving in the military for almost 3 years, and have a GA firearms license. I also have a collection of firearms. Recently I went through a pretty nasty breakup with my Fiance, whom i have an 18 month old daughter with. We seperated mainly because of her drug addictions and behavioral problems. After the separation she began spreading horrible lies about me all over town. She was always very anti-guns, and still is. She hated my collection and the fact that i carried. I am a well trained and responsible firearm owner, though she would claim otherwise. She has no proof of any of the accusations she has made, which include "pointing a firearm at her while in traffic." In fact i even have a witness that was with me when i allegedly pointed the firearm at her, who testified that i never did such a thing. And several other very credible character witnesses. I also have a completely clean backround, shy of a speeding ticket. After she began spreading these lies, she had a TPO taken out against me, which restrains me from being able to come within 200 yards of her, or my daughter because she claims i am dangerous. Before these problems involved any legal matters or authorities, i sold my collection to a friend of mine for safe keeping, knowing that things were going to get rather ugly with my separation and i did not want her to use my firearms against me, unfortunately i made this decision a little late, and it actually ended up making me look even worse, her lawyer made it look as if i sold the guns after "pointing one at her" in order to avoid getting in trouble. When i was served with the TPO i was ordered to surrender any and all firearms, which i no longer had at the time. A few weeks later, my ex fiance spotted me in traffic and followed me around town for nearly 30 minutes, in fact she finally ended up following me right to the police station, where i filed a police report against her, of course no actions were taken by the police or legal system. When questioned by my lawyer later on, she stated "she was following me to see if i had a gun" but also stated that she was in fear for her life at the time, this made no sense to me. She was never punished in any way for stalking me, nor was it even put on her record, after i filed the police complaint. I also have a credible witness of her stalking/following me that day, who happens to work for the sheriffs office. When i finally went to court, there was no evidence against me at all, other than a few facebook posts and myspace posts that were completely taken out of context and used against me, none ever stated her name or anything of that nature, and some of which were over 5 years old. I was never proven guilty of anything, nor was there even reason to believe i was guilty of anything, and like i stated before, i had a credible witness for the crimes i was accused of. My lawyer warned me before hand that my gun collection was going to be used against me in every way possible. As it turns out, the judge in our case is well known for disliking guns, and being very anti-firearms. When the court hearing was complete, i was completely confident that the judge would rule in my favor, drop or atleast reduce the TPO to a restraining order from my x, which would be fine by me so long as i could see my daughter. We obviously destroyed them in the hearing, they were caught in several lies, and had a lot of "i dont know" answers. However the Judge decided to extend the TPO for a period of 12 months, which restrains me from seeing my daughter. He also ordered that i have a very thorough and very expensive psychiatric evaluation done, which after paying for the lawyer i can not even afford to take now, this evaluation is expected to take around 4-6 months and could take as long as a year, i am not allowed to see my daughter until after the exam and next court date. The judge also ordered that i not possess nor even be round ANY firearms. This is causing me severe issues due to my military affiliation, and desire to pursue a career in law enforcement. I have now had to turn down one job with a police department, and one with a well respected armed security company due to the judges ruling that i stay away from firearms
I was just hoping maybe somebody could help give me some advice, i feel like im stuck, and being punished for having a firearm collection. I can understand some cause for concern with the allogations made against me, but feel like this is a little extreme and unfair. During all of this, my firearm permit was never suspended nor revoked. It sits still in my wallet so as any GA firearm permit owner knows, i could at any point walk into any gun store in town and purchase a gun if my intent was to hurt somebody, which of course it is not, as i have not done anything of the sort. This alone should show the judge that i do not intend to harm my daughter or my x, and am fully capable of seeing my little girl and being allowed to have my firearms back. I would be glad to explain this situation in more detail if somebody would like to contact me. I just need some advice and dont know what else i can do.
