My 18 year old asked my to buy him a handgun

So long as I know them and the are not a prohibited person, I will. I don't need the ATF to side with me, I or anyone else that buys a gun for a family member is not doing anything wrong. If it came down to it, all I would ever need is a judge or jury to side with me. I have provided the laws for you to read. What you do with that knowledge is up to you.

LOL, godspeed champ.

A straw purchase is an illegal firearm purchase where the actual buyer of the gun, being unable to pass the required federal background check or desiring to not have his or her name associated with the transaction, uses a proxy buyer who can pass the required background check to purchase the firearm for him/her. It is highly illegal and punishable by a $250,000 fine and 10 years in prison.

unless the law has changed its 21 to purchase or to possess a handgun and you have to be 21 to buy ammo as well, my 1st cousin is a deputy in hall county and he is 20 he can't possess a handgun on duty for any reason... please talk to mom first and then between you guys discuss his purpose of wanting one, not only ask is he mature enough but ask if his friends are as well ..." moms out of town come over tonight and lets party...his friend finds it and then OMG i didn't know it was loaded" then the thought will always be on your mind TOUGH CHOICE

You are wrong my friend. Any P.O.S.T. Certified Peace Officer can both carry and possess a firearm without a GWL.

Buying a gun for the kid's use doesn't mean he gets to control it all the time. It just means When you go to the range, he's the one who uses it. Think about it, whose gun is the little pink Cricket 22 in your safe?

On a 4473 it clearly states "You are also the actual transferee/buyer if you are legitimately purchasing the firearm as a gift for a third party."
Since when does ASKING for it make it no longer a legitimate gift?
"Daddy, I want you to buy me a gun for my birthday/Christmas/Groundhog Day/just because I'm your son."

Fantastic. Can you cite this law? The one that specifically notes the highlighted part above as well as the one you claimed earlier that if a person (not prohibited from ownership), ASKED for a firearm as a gift and a family member bought them said firearm they are guilty of felony. I want the actual law, not something cut and pasted from the internet, not a screen shot of a 4473, the actual law to be referenced. You have been asked multiple times now to cite the law, I gave you the entire chapter so you should have no trouble finding it if it exists. Until you do that all I hear is MUMP, MUMP, MUMP.

Its insane the turn this thread has taken, but you are absolutely correct that it IS NOT a straw purchase. I just bought my son a handgun he has been wanting and asking me for. He did not hand me $XXX and tell me to get him any particular gun. The idiotic argument of straw purchase when buying a gift for a child surely has to be to stir the pot.

Had a 19 year old in my mandate class years ago, and State law still is 18 to be a certified LEO

It doesn't. Notice he isn't even acknowledging he said that earlier, he has moved on to trying to define (terribly I might add), what a straw purchase is. He still has yet to produce ANYTHING that supports his claim below.

A gift is one thing, but this was a request for purchase, ie a FELONY. Age restrictions aside, the fact that he/she ASKED you to purchase makes this a straw sale. Relation makes no difference in the eyes of the law.

I believe what we are witnessing is what is commonly called "back peddling".
