Yahoo article on current gun deal has this line in it, "Private transactions that are not for profit, such as those between relatives, would be exempt from background checks."

http://news.yahoo.com/dem-gop-senators-reach-background-check-deal-141013387--finance.html

Depending on how this is worded, private sales may still be viable and legal, as long as they are "not for profit."

So, all this would do would be to outlaw private sales, for profit, which technically isnt allowed now.

hmmm, interesting. Sounds like there would be a lot of confusion though. We already have too many people that require BOS's and there's nothing that indicates they're needed.

If this new 'compromise' is based on the Schumer bill (which it pretty much has to be), this exemption is only between immediate family or spouse.

The bill requires that all other sales go through an FFL. That means you don't sell or trade a firearm to the buyer, and get a background check. You sell the gun TO the FFL, then they treat your buyer like a regular retail customer.

There's nothing to say that the dealer has to stick to the terms of the 'deal' you negotiated. Once the firearm is in their inventory, they can do anything their conscience will let them do with it.

If the buyer fails the NICs check, and the FFL lets you get the firearm back, you will have to repurchase it (and pay sales tax) as well as do your own background check.

Any purchase, sale or loan (beyond 7 days) of a firearm to someone who isn't a spouse or immediate family is a felony.
