Interesting, they even implied "sporadic or situational use" is OK, but permanently modifying the gun so it can only be used as a stock and can no longer be used as an arm brace is not.
 
I'm thinking that ATF's intent here is to force the manufacturers of these devices to ONLY market them to the public as braces for extended-arm shooting, BUT..

... once you buy one, YOU, the customer, can choose to stick it on your shoulder if you like.

Just don't brag about having a tax-free transferable SBR that ATF doesn't know about.

Just don't encourage others to exploit this loophole.

And gun stores, distributors, and manufacturers should not market and promote arm braces as substitutes for shoulder stocks.

(It's kinda like the "don't ask, don't tell" thing for gays in the military years ago).
