Site feedback: When is a deal made?

I backed out of a almost deal yesterday.
I had two like items.
One sold.
Im keeping the other.
Two parties very interested in both.
One made the deal.
The other guy got hung out to dry for now.
Time place location price.
Easy right?
 
I don't think the rules for this site are clear enough in describing when a negotiation has resulted in a deal, either "I'll take it" or some other equivalent.
By "a deal" I mean an agreement which obligates both persons to actually show up for the meeting and buy the gun if it's in the condition as described.
Or, for deals that involve shipping firearms, the "deal" would be one that obligates them to each perform their own obligations to send the money, and to send the gun.

Now I realize that there are some comments about this in the rules related to leaving negative feedback .

The trouble is that when going into a deal somebody may not even be considering that the deal will go south and therefore somebody might leave bad feedback.
Leaving negative feedback may be the furthest thing from anybody's mind at that point, as a bargain is being negotiated and finalized, or close to finalized.

I suggest that somewhere on the side everybody who does buying selling or trading has to see a statement of what is considered a "deal" having been made here at ODT.

If the only things that the Admins of ODT want to say on the subject are the couple of sentences about it that are found in the negative feedback rules, fine, but let's just repeat that somewhere else more prominently.

1- "I'll take it" means nothing unless the advertiser says it will.
2-- There is never an obligation to buy a gun, only an obligation to show up at the agreed-upon meeting place and time and consider buying it after inspection.
3- selecting a date and time for the meeting, with agreement by both parties, is the proof of the deal being made ( but again, it's only a deal to meet and inspect the item).
4-- The only acceptable way to prove the agreement of a meeting place and time is through posts or private messages right here on the ODT, not communications in any other form.

I don't think these few rules about leaving negative feedback are good enough, and they're quite a bit different from how the rest of society works about contracts.

I suggest we have a statement that reflects basic common-law principles of contract formation.
I suggest we give some specific examples of the difference between negotiating toward a deal and actually having a deal made.


People have trouble with the simple rules as they are now. Not sure making them more complicated is going to help. Having reviewed more than a few "committed deals" in regards to feedback, the only issue I see with the current rules is that people don't read them (no matter how many places they're posted).

If there where hard set rules, the site could be implicated in firearms dealing.
That is not what this site is, for all intents and purposes this is the wild wild west.
Private sales, when mediated by others (website owner, moderators, etc), are no longer private, and are subject to be described as a brokered deal.

Well, OK DanKATL. Obviously, you don't believe the members here read the rules. How many places are the rules posted? I can find the Rules and Guidelines of this site listed under Forums, then go to Site News & Feedback, then click on Rules & Guidelines. Where else are they posted? If the Rules & Guidelines showed directly under Site News & Feedback, maybe more members would read them. Maybe not, but a heading dedicated to Rules might help.

Rules should be followed by our members because when they became members, they agreed to the rules of this site. But, the MODS should follow the rules of this site as well. Maybe the MODS should read some of these rules again. Lately, this site has quite a few posts that do not adhere to the rules, and for some reason they are allowed to continue by those in charge of moderating this site. Crass and inappropriate references are not supposed to be in open forum. Stupid Stuff does not require permission to view, therefore, it is an open forum category. There is a place on this site where the rules are more relaxed. Move those threads and posts to that area.

We are not a porn site, we are not a political debate site, we are not a religious site, and we don’t want to spend a lot of time moderating and debating those topics


“Dildos, drugs, etc” - In the public forums (any forum you can see without being logged in), we ask that you refrain from posting references to these topics and others like them: dildos, trannies, heavy drug use, midget porn, etc. We don’t necessarily have a problem with any of these topics when they are part of a “real” discussion and not serious conversations, we’re just a little tired of the inevitable midget porn or dildo reference that tends to show up occasionally, we just feel it does more harm by alienating members than it does good.


Please keep the language at a level that would be acceptable in most public places, as much of our site is exactly that. The private forums have more relaxed rules but they still have limits.


As long as a topic can stay civil it will be allowed to stay in the public forums. If it becomes too much work to keep on topic then it will be moved to the private forum.


Please do not post any lewd, crude, or disgusting pics in the public forums. This would include anything that would make a normal person throw up or get too excited. If it would be considered acceptable in an average workplace then you should be fine.

Well sir, some of us do not have time to read every thread here. If you see a thread like that there is a report post function. It will get reviewed and moved accordingly. The timing may not be to your liking as ODT is not a full time job, but it will get reviewed.
