When the US territories expanded and the US couldn't pretend that the Indian reservations were really viable sovereign states, (plus a bunch of other admin reasons) they made them citizens and Poof! The 14th applied to them.

So if an Indian was off the reservation for whatever reason in 1920 and had a baby that baby was suddenly a U.S. citizen? You funny guy! :pound:
 
By a strict, contemporary reading of the Consitution? Yes. In the bigoted environment of that period? Probably not. If she was allowed into a white hospital at all, they probably wouldn't have even bothered to do any birth certificate paperwork, just shoved her and the baby out the back door as soon as they could.

Exactly! Which is the important part of the 14th that you DID NOT bold, but here I'll do it for you. "and subject to the jurisdiction thereof,"

If you are born in this country, and your parents are here illegally and SUBJECT TO A FOREIGN GOVERNMENT, you are not a citizen!

Funny, I can't find those footnotes in the 14th Amendment where there are bunch of conditions attached to it? Is it only on Tuesdays and Thursdays as well?

So the Indian Citizenship Act was unnecessary? Man you could have saved them a LOT of trouble.

We aren't talking about the illegal alien mother. We are talking about the new person that pops out of her on American soil. The 14 Amendment says it is a US Citizen. Period. Effectively always has been since the days of Jamestown, the 14 Amendment just codified it and kept the South (Racists! Democrats!) from twisting any lesser law into depriving any group from that right (blacks originally, now children born to illegals).

Sorry but those are the rules of the game. You want to fix it, stop/dissuade the prego madres from getting to US territory.



Doesn't matter. And IIRC, it was also applied to the tens of thousands of Irish that came over to American specifically to fight for the Union Army.
And it allows wealthy foreigners to fly here,give birth,and that child has the same rights as any other American. That is messed up, amend the amendment, heck that's what Obama's parents did.

Why is that messed up? Those wealthy folks probably paid for the delivery, are not likely to be burdens on The State, and most likely will pay tuition at a US university.

Just like the poor little Mamacitas that plop out a rugrat, we are talking a tiny number, so small compared to the TIDAL WAVE of mostly young working age men (which includes what we call kids) coming here and living right under the noses of you, me, and the laws that are supposed to prohibit their very existence here, but yet live here for decades. Our immigration policy is broken in much bigger, more profound ways. You guys are making a tempest in a teapot over a side issue.

It should not be legal. One avenue left open has led to many more in our past. Look at the loop holes Obama found and used his magic pen to help opened the flood gates for ilegals to come through Mexico.
