Unfortunately, she would have won everything in spousal support anyway most likely. We faced that with my wife's court and that is how she won the estate and the fact nobody could produce a valid will from her stepmom's side.

From experience, that does not have to be filed, but if the old will is found then he could contest and at the very least it could be split but every child could get a part.

She still has an interest in her late husband's interest, so it is OP, siblings, and widow.

If I've followed the thread correctly, there are 3 siblings, so widow and each child would get 1/4 of 50%, or 12.5% of the whole thing, meaning widow ends up with 62.5%.

Unless there is a survivorship clause, as you noted.
