House to house searches

There were no violations of rights of homeowners that I have heard of. Can you point any out?

My apologies, in fact, I suspect all of the DCU wearing FBI and local police followed the letter of the law and let the homeowners know they had the right to refuse, before barging in... thanks for the correction.

I'd suspect that he's probably right. I'll bet the farm that the vast majority of folks were beyond willing to consent to a search of their homes without probable cause. It's the patriotic thing to do after all.

2. Because there aren't any reported does not mean there wasn't the potential for it.

There is a potential for rights to be violated every second of every day in every part of the country. That does not mean anything more than saying there is the potential for you to become a homicidal maniac every second of every day.

Fact: The choice to not exercise a right in a given circumstance does not eliminate or infringe upon that right in any way.

You have the right to walk outside and down the street carrying a loaded AR-15 across your chest pointed at the sky. Would you also choose to exercise that right under every circumstance (say while the police were in the middle of a shootout with criminals who are using AR-15's to shoot at the police)? If not, have your rights been violated by choosing to not exercise that right in that circumstance?

Cite the "letter of the law" which says officers are required to inform you that you have the right to refuse their request for a search without a warrant please.

One of those actions protects you and your family, and the other potentially endangers you or your family. Your rights afford you a choice, and it's up to you to make the right one.

I have never said that individuals do not have the right to refuse a search without a warrant. I said that in some circumstances it is in the best interest of society, and individuals, for individuals to not choose to exercise specific rights. I'm also pointing out that choosing to not exercise a particular right in a given situation does not infringe upon, or eliminate, that right at any other time.

Again, right on the money, my friend... they can certainly can take advantage of the American public's ignorance and I'm sure, in this type of situation, did. As HGUN says, it's up to the individual to know and decide what is best. It's not the Police's job to support an individual's right... it's there job to find wrongs to punish.
 
I would be happy to let A police officer walk through my house to make sure there is not a person in there.

That is if the officer is one if my friends that work for cobb or smyrna PD. but unless its one of my personal friends no other LE is searching my house without a warrant.
