Romero was the first to plead guilty on April 28, 2015. In his plea agreement, Romero admitted to manufacturing and selling six AR-15 type semi-automatic rifles bearing no manufacturer’s markings or serial numbers and built from unfinished lower receivers between the dates of December 8, 2014, and March 6, 2015. Like Bautista-Marquez, Romero did not have a license to manufacture or deal in firearms at the time. Romero is scheduled to be sentenced by Judge William Q. Hayes on July 20, 2015.

He was also manufacturing for profit!
You can still decide to sell your manufactured firearm if you later decide you dont want it anymore.
you are NOT allowed to sell it if your intention was to manufacture for profit.

Nothing in the regulations mentions profit. you can lose money on every one you sell and still get arrested

if you're building them to sell you are breaking the law!
if you sell one you built because you're tired of it or decide you dont like it then its legal!

The ATF has no set number you can sell before they charge you with selling without a license. You are playing with semantics. There is no build intent rule either. The ATF has an unlimited budget. They have lawyers on staff who get paid win or lose. It is cheaper to get an 02/07 than to defend a court case. It is even cheaper when you get tired of said gun just to cut it up and throw it away. Even if you are right and win. If you get on ATF radar you can spend 6 figures defending yourself.
