What happens if you shoulder it?
You make fire balls... Nothing really, you can already put the pistol buffer tube on your shoulder. It's just dealing with the people not in the know (including LEO) that might be a pain.
Yep, legally you might be okay but be prepared for the possibility of some hassle. I don't know the law myself since I'm more of a SBR guy. Hell, be ready for hassles even if your firing with it correctly.
From the ATF letters I've read, it seems that they care more about 'Intention' than misuse.
It's how the item is intended to be used, not your intent on how to use it.
The question they attempt to answer is was this item intended to be shouldered. Here the tech branch decided the Sig brace and pistol buffers were not intended to be shouldered and therefore legal, even if you do shoulder them.
