Shot placement in a self defense situation.

As documented in the article an attacker may not stop advancing even when taking hits in center mass/ vital organs. The cop had to shoot him in the head to end the gun fight. This got me thinking. In a civilian self defense situation, if you shoot the attacker in the head, would LEO, judge or DA or whatever see it as malicious intent and not self defense?
 
Not all bad guys are going to stand up straight in front of you. I'm aiming for whatever body part is easily visible at the moment, chest, head, legs, ass, I don't care. If its a clean case of self defense it really shouldn't matter.
 
There was a training video posted a while back that I liked. Start out shooting center of mass, and with each shot, move up the target creeping towards the head. They were saying that in a tense moment, where the perp is high or wearing armor, you would have more effectiveness with that method than with dumping into center of mass.
