As someone who has had the unfortunate experience with being involved in a number of law suits, I can tell you that anyone, anytime, and for anything can and willl bring suit against you. There appears to be a few lawyers out there that have no problem filing for matters that they know will not prevail, just to get in a few more billable hours. I know that the idea that frivilous filings can be thrown out of court by judges, but keep in mind that a lot of money can be burned up while the judge makes that determination. And the aware of attorney's fees will likely require more hearings ... and that aa judgement against someone who has few assests is meaningless!
