If I had a vape pen which is a felony and my gun came up missing, but I didn’t catch the felony, I believe I would just leave that **** alone unless he wants a new charge🤷🏻‍♂️

I MAY be wrong here but I don't think THC vapes are a felony in GA. Every vape shop around here sells them out in the open. I realize that if you're pulled over with one in your car there probably IS some weak ass charge they can stick you with but I don't THINK it's a felony.

But that cop couldn’t come back and charge him for something that happened a few days back that he should have charged him on that day….whats a judge gonna say ??
“Why did you wait to charge him officer??”
“Well your honor, he pissed me off a couple of days later so I figured I would reciprocate the charges to teach him a lesson !! “….

Hell naw !! I doubt that would fly !!

Yes they are. THC oils are a Schedule I controlled substance. However there’s a threshold to what’s actually illegal vs what’s “CBD/Hemp”. Most of the time, people buy these pens and can clearly see on the box it says “This contains a schedule 1 controlled substance” with the CA MJ flower stamp.

I believe they can do whatever make your life miserable, it may not stick in the end, but I bet it’ll cost you some retainer fees and stuff at the least

Getting a secondhand story, and then coming to the ODT to get legal advice, ain't the best way to go. Every single time that I've dug into a story like this to get to the bottom of it, I've found that the facts don't match the story.

The person who owned the firearm needs to get a copy of the police report. If the firearm is not listed as placed into evidence on the report, then they need to speak to a supervisor and start the process for filing a complaint.

It would be best if they have the serial number with them when they do so. If they have a receipt showing the purchase (with serial number on the receipt), or a copy of the 4473, then that's even better. If they don't have a serial number, plus paperwork showing that they own that serial number, they will have a hard time proving a Glock is theirs.

If LE found the firearm, they would not leave it in the vehicle to be towed. It would go into evidence so that it isn't stolen from the vehicle. That's SOP in every agency that I have personal/professional knowledge of.

I took a wife's young ( 20 y/o ) friend home from work on Tuesday , & she stated back in Oct her 21 y/o BF was pulled over for speeding 52 in a 45 by Cherokee Co .

They smelled weed ( as usual ) fishing IMO . & He had a Glock in a bag with 3 grams of weed & a MJ Vape in a backpack on the back seat and did not tell them he had a gun . Dumb I know . I 90% recall her saying he was charged with Speeding & Weed , no felony . & They towed the car even tho there were 3 legal drivers on scene and 1 mile from home .

Anyway she said the Gun has disappeared , & not on the report that she knew of , I asked about the tow inventory but she did not know .

I hope 'someone did not take this guys gun ' I don't trust some cops from experience but he could have lied to her about it but IDK .

I told her to check the paperwork & report it if it was stolen , & 52 in a 45 on Bells Ferry Rd , OK !!!

If guilty cool but I don't want to see a young person taken advantage of .

Was the speeding in a school zone? If not, the story doesn't hold up as 52 in a 45 wouldn't even be a speeding ticket:
