We are all arm chair quarter backing. The aggressor "could have been" retreating when they sped up, or they "could have been" trying for a better angle to continue. Those three rounds in the windshield "could have been" the reason the aggressor KEPT going.

Exactly what I was thinking. Easy for people to critique the situation now.

I don't think they were driving during the shooting. The "victim" claimed he was forced over onto the shoulder and the "aggressor" pulled along side him where it appears from his statement they both stopped (most likely to exchange pleasantries). How the bullet holes ended up on the passenger side of the car? I still can't figure that out.
