Pretty sure Georgia’s law includes the curtilage. Plenty of case law all the way to SCOTUS and every state Supreme Court as far as I know.


What is included in the curtilage?

• Yards, whether fenced or not
• Porches, patios, and driveways
• Outbuildings like sheds and garages
• Any area that is necessary and convenient for the family's use

Problem is people think that “Stand your Ground” includes hunting the perps down and extracting revenge for the entry on the property to start with.

Stand your ground just means you don’t have to retreat before defending one’s self any where in the state.
If you are not in fear of death or great bodily injury you cannot use deadly force.

You can stop them from destroying your property, like starting the house on fire. But not for leaving with a stereo.

Every incident is different and circumstances should be evaluated each time. But my advise is to never shoot at anyone that is not directly trying to harm you.

Now if they entered in a violent or tumultuous manner that is an entirely different matter, and is not a “stand your ground” scenario.

This is a situation where less lethal weapons may be useful. Still might not be legal to use in protecting property and less lethal doesn’t mean it can’t be lethal.

I think we all don’t want victims and protect our property. Also don’t want go to jail over a torque wrench and string trimmer either.

What’s everyone one thought on less lethal gun that shoots hard rubber balls or pepper balls with compressed air in these situations?

I ask because I was thinking about getting a Byrna

Then again I don't think the whole story is reported. It didnt say if he confronted them first and was forced to stand his ground or just walked up and started firing into the building.. important details left out. There is way to much NOT known to judge.. good info above of diffrent scenarios that could keep one of us out of cuffs

I would vote "NOT GUILTY."

Hell would definitely freeze over and all the other jurors would be looking at long-term care options before I voted to convict of anything, even littering from his spent shell cases.
