Advice on action to take after being threatened with a gun

Let me get this straight.

Your kids were being noisy in the afternoon, guy bangs on the ceiling, runs upstairs unarmed, argues, runs downstairs to get gun, and returns with a gun in a bag?

You were never in any danger.

The idea was to solicit advice.

You cannot possibly know someone's intent. What do you feel would have constituted being in danger? Should I wait until I am in danger before I start taking advice on planning or start thinking about taking action?

Just curious?

Situations like these ( we call them "freebies"...) are good opportunities to review what you did right & wrong, what you would do different, what steps need to be taken to prevent escalation, what documentation you have with the police or would like to have in case the other party escalates, & what are your plans/ options to deal with anything from another passive-aggressive encounter all the way to a surprise armed ambush at close range. Many armed encounters happen at very close ranges where there is a huge difference between shooting a gun vs. fighting with one at arms length in a surprise attack.

I would also highly recommend reading up on the laws on the use of deadly force beforehand. It would be better than learning them in court or from behind bars.

I said as much to the responding officers and they didn't seem to see my point. He started the confrontation, he escalated it, and at the end of the day the leo's voiced that they could just as easily arrest me as him.

All the more reason to follow up on it with a supervisor. If he doesn't give you a satisfactory answer, ask to speak to his. Seriously, based only on what's been posted here I would consider this a pretty serious incident. Neighbor threatens with gun, leaves and returns with bag believed to contain gun? This warrants further investigation. Hindsight is 20/20.

Get a good set of recording cameras. They are pretty cheap now a days and easy to set up.

Could have been X-mas cookies. I didn't inquire, next time though I'll definitely be sure to ask. LOL!

You should be able to use his threat to break the lease

Get a copy of the incident report
Mail it to the apt leasing manager
Asking to be released from the lease for you and your families personal safety

If you call or walk in the office they will tell you no

In writing with a copy to their attorney
The leasing manager should be happy to see you go
