The seller should have told THE FIRST GUY to clearly say "I'll take it" that he's setting it aside for him, sold pending funds/ meet. Tell the next (in time to respond) person that if the first guy doesn't get it, either by changing his mind or just not following through in a reasonable amount of time (couple days, max.) THEN it'll be offered to person #2.
