Atlanta homeowner charged with murder after allegedly shooting stranger found sleeping inside home

The part that gets glossed over is the 'confrontation' mentioned in the article.

Guessing that the homeowner was PO'd and started it, since it would be stupid to try and charge a homeowner who was attacked in their own house.

Not saying a woke DA wouldn't try, and maybe they are just hoping for a plea. That seems to be SOP in these iffy situations.

Say someone screwed you over on a drug deal, loaned them money, hurt someone you care about or they screwed your wife/girlfriend easiest way to try and get away with killing them would be invite them over under a false pretense and blow their brains out. You don’t have to believe it but it has and does happen.

Are you saying your sister has knowledge that the DA is going to wrongfully push charges to set an example against people defending their homes?

That was my exact first thought when I saw this considering the jurisdiction. Dekalb and Fulton county cannot wait to make examples of anyone they can prosecute defending themselves. This will become a trend....
 
This has all the earmarks of the home owner being under the common misconceptions that if someone enters your home you can justifiably kill them and that claiming you were in fear for your life is a viable defense. There are several folks right here on ODT that have expressed those exact beliefs.

Comparing this obvious sociopathic murder to the context of shooting an unknown intruder in your house whose intentions you do not know is a long reach though.

Its one thing if you shoot out of pure survival and you immediately call the police. If the perp is still alive but badly wounded and presents no further threat then it should be obvious that there wouldn't be any reason to continue shooting them. At that point its absolutely murder.
 
We'll find out more you can bet, but if he was the aggressor and caused the 'confrontation' then he's on shaky legal ground.

A lot of folks don't have a good grasp on how specific the criteria for a self-defense claim is. One of these is that the attack on you was 'unprovoked', and I'm guessing that's where this guy screwed up.

The 'right' answer here would have been to snap a picture of Sleeping Beauty as proof and then call the cops.
