gun pulled on me today- need help

There always seems to be a shortage of courtesy and abudance of asshats on the road.

I think some are forgetting that whether or not the other person had a GWL or not has not been established.

Also consider that if your vehicle is an Extention of your home, there would be curtilage, or the area immediately around it.
Or would it be reasonable to say you should
not be armed if you had a flat tire or got out at a wreck. The legislation was clear that reasonable carry should not be restricted by LE.

***understand I am not saying who, if anyone, was at fault. I am only speaking to the facts as articulated by the OP***

The main reason, if I was the officer, would be suspicious of the OP is he admits he fully expected the other party had to let him in even though that is not the case. Then as he says that when someone approached the car, as would be expected in a minor wreck,and that the persons might be upset is is a reason to grab his holstered weapon. Hell, how many here wouldn't get out at a minor wreck, and be upset under similar circumstances? I am assuming the other driver was concerned he was leaving the scene or was aggressive, but I have no way of knowing what was in his head at the time.
I doubt either party should have resorted it a weapon if there were clear heads and not emotions.

The officer would not, with the few facts we know, be able to discern who would have been in the wrong.
Although I suspect he had an idea or he would not have issued a citation.

Everyone is taking the side of the OP because he is a member here, the officer would not have that luxury.
Im curious if the OP has a picture of the damage. That would go a long way in an assumption of who was at fault for the wreck. Although there is case law for when someone cuts in front of someone and the rear party is unable to avoid a wreck, regardless of who "fully took the lane" (unless the person did it intentionally as the OP suggests)


Now I also am fully willing to support the OP if he is truly without fault. However the way he has articulated his case here has not really helped his case. That is not to say I am completely convinced he is partially or completely at fault either. I am only pointing out what the officer or DA would be looking at.

There is always two sides to a story. In my experience the truth lies somewhere in between. As I suspect is the case here.

I just wanted to know if it had happened similar to what myself or Geax had pointed at...surely you would see it in a different view...

I also understand you did not want to mislead OP..
 
Sounds like if you felt that threatened OP you should look into taking a class on self defense instead of worrying about this guy not being charged. In a car with gun still hosltered the OP wouldnt have had a chance IF the other driving did intend to do him harm

In the case of Geax's senario?
Probably too late as he did not see it coming and the perp would have too strong an advantage to commence with a gun fight. Not to mention his family that would have been caught in the middle. In that case his best defense would be to hand them the keys and tell them goodbye.
However I've never heard of this type of scenario when traffic was stopped, there are numerous witnesses, and escape routes would be restricted.

Yeah I was letting this go, along with the advise from others to fight it out, as I am really not trying to down the OP as I would assume, without further reason, that he is an honest man. I am just pointing that the way he explained it doesn't sound good.
 
Hi guys! Man Ive had such a horrible day. cant even go to the fleamarket these days. so heres what happened:

Me, my female friend, her son, my mother and daughter were headed to the fleamarket. there was a car that didnt want to let me merge into 75 from the off ramp (we were at a crawl) they finally backed off enough where I could get in the lane. as soon as I did they ran up and hit the rear of my jeep, then pulled up beside me and the woman started beating on the rear window (where my 6 year old daughter was sitting) we Imediatley called the police (2 women and 2 children in the car to protect) I pulled over at the next exit, I was gonna go to a public parking lot like homedepot. but before I could them and there friends boxed me in at the end of the exit ramp. they all jumped out of the vehicles and crowded around my jeep. next thing I know the guy walks over to his car, pulls a gun out of the car and charges it while staring at me. at this point I had my hand on mine (still holstered.) then he proceeeds to walk around his vehicle like he was going to do something -praise lord the police showed shortly after.

when the police arrived i offered them my ccw permit he declined to see it considering I never left the vehicle. makes since, but they did not ask the other guys permit and he pulled a weapon on me and charged it. the cop charged me with the accident (wich im not worried about because I will be in court to fight it-they hit me in the rear with the front of there vehicle AFTER i was in control of the lane) but then he gave that guy his pistol back and let him go- im sitting here truly thinking that I was going to have to kill this guy and they dont charge him with anything and let him go? I asked the officer nicely why he didnt charge the guy with pulling a weapon on me and he said that because he didnt point it at me he didnt pull a weapon. I called the ACTIVE SUPERVISOR of henry county police south division- he also said the guy didnt break any rules. I asked about the guys permit and they said he wasnt required to have one and could carry the pistol all he wanted to by his side loaded without a permit- that is NOT ga law! ga law says inside your home car or office or plain view with a long gun- they are just trying to cover there tracks now but I think that the officer needs to be reprimanded, and the guy should be charged with pulling a weapon or atleast carring without a permit- cause These were not law abiding people id bet everything I have they dont have a permit. these are the type of people that get us law abiding gun owners a bad rep, and cause all kinds of trouble. survivorjohnny had a good point- any police would have shot him.

How would you proceed? let it go? justice system fails again, and this guy probably ends up killing an innocent person later down the road- or go over the supervisors head ? news channel? ...............????????????


On a side note hello to all the fellow odters that I have come to know!- I didnt fall off the face of the earth just been really busy with work.
 
To begin with,he didn`t have to let you merge. You have to slow down or stop until someone lets you in,or traffic has a gap. Most people around here don`t know the law. The merger has to YIELD. If someone lets you "in"by slowing down, he or she is actually obstructing traffic. You could have followed the law and saved yourself some trouble.Nobody has to yield to let you in. On the other hand the idiot who pulled his weapon lacks the maturity to carry one. You will win the accident case. Good luck.
